At Hamoye Limited, the creators of Hamoye (referred to in this document as “we”, “us”, “our”) your right to privacy is greatly respected. This Privacy Policy has been created in order to outline to you the way in which we treat the information that we receive from Hamoye. This Privacy Policy applies to our app only. We are not responsible for apps or websites that we do not manage, nor does this policy apply to people or companies over which we have no control. Apart from in the specific instances that are explained in this Privacy Policy, in our Terms of Use Agreement, and in other documents related to the usage of our website, we do not release any personal information about our users unless we obtain their permission beforehand.

What Information is Covered in this Privacy Policy

It is possible to use some features of Hamoye without submitting any personal information. In these instances, we will only collect Non-Personal Information such as the pages within the app that you visit. This information cannot be used to identify you. However, in order to access the full features of the app, you will need to submit some personal information. This Personally Identifiable Information may include such details as your name and email address. You must ensure that this information is accurate, as if it is wrong there may be difficulties in fully utilizing the Hamoye’s services. For instance, you must make sure your email address is correct and up-to-date as this is usually the main way we keep in contact with you.

What You Consent to When You Use Our Website

When you submit Personally Identifiable Information to us, you are agreeing and consenting to our right to save, collect, use and share this information as long as this is in agreement with this Privacy Policy and our Terms of Use, and as far as allowed or required by law. Please do not submit any Personally Identifiable Information to Hamoye if you do not agree with these terms. However, if you decide not to provide us with this information, or if you choose to later withdraw your consent, you may not be able to aces the full range of services that Hamoye offers.

The Information We Collect

There are two types of information which we collect about our users:

NON-PERSONAL INFORMATION

When a user visits Hamoye, a number of non-identifiable details are made available to us, which we may track, gather and use. This information includes the time and date of the visit, the pages within the site accessed, the order of the pages visited, the links clicked on, and the web addresses from which the user linked to our service. When we collect this information, we may log the user’s IP address, their operating system and/or their browser. This is classed as Non-Personal Information, but it could be possible to find out a user’s service provider and their geographical location from their IP address.

We may also use cookies and/or web beacons. Cookies identify the user to Hamoye’s server. Web beacons are small files which link to our servers and allow us to track a user’s activity on the website. Cookies and web beacons help us to identify visitors that return to Hamoye, the length of time users spend on different parts of the app, the links to and from the app, and the features that the users make use of. They help Hamoye to provide a better, more efficient, personalized service to Hamoye’s users. We do not use cookies or web beacons to collect Personally Identifiable Information. We may occasionally also use other standard ways of gathering data.

Most browsers allow their users to control whether to accept cookies. You should be able to find instruction on how to reject cookies through the help sections of your browser’s documentation. However, if you do decide to reject cookies from our site, many features of the app may not work fully.

PERSONALLY IDENTIFIABLE INFORMATION

When you sign up for content through Hamoye, or when you register for email updates, take part in our forums, send emails to us, take part in courses or receive any other service from our app, we collect Personally Identifiable Information that you provide us. We may use this information for a number of reasons, including providing you with the content, sending you updates about our other content, sending you messages about other Hamoye events or other important information such as about site maintenance or updates, or responding to your queries.

UPDATES

Hamoye may offer the service to receive content updates either by email or by posting this information on locations of the app that only registered users can access. If you would like to subscribe to these services, it will be necessary for you to submit Personally Identifiable Information, such as your name and email address, to us.

FORUMS

Occasionally, we may offer public forums on Hamoye. On these forums, you will be able to share your thoughts or make comments. If you would like to take part in these forums, it will be necessary for you to submit to us Personally Identifiable Information such as your name and email address. This information will not consist of anything you post, send or receive through the public forums.

PARTICIPATION IN ONLINE CONTENT

Occasionally, we may offer you the chance to take part in online courses through our app. In order to participate in this content, you will be required to provide us with Personally Identifiable Information, such as your name and email address. In addition, we (or our third-party service providers) may gather information concerned with assignments, tests and other forms of assessment related to the content. For instance, if you take part in a proctored exam run by Hamoye or by one of its third-party providers, it may be necessary to receive Personally Identifiable Information from you in order to verify your identity. In order to do this, you may be asked to provide a signature, a photograph or recording, or information from an ID card or document. We may need Personally Identifiable Information from you in order to monitor your behavior during a test to ensure that the test requirements are being adhered to, such as ensuring that you are not using resources which are not allowed. We may also gather certain information about your performance, such as scores, grades and teacher evaluations.

COMMUNICATIONS WITH HAMOYE

We may receive Personally Identifiable Information from you when you send us an email or when you contact us through other modes of communication.

PROVIDING SERVICES TO YOU

You may be asked to provide Personally Identifiable Information in order to use such services as chat rooms that allow you to talk to Hamoye staff.

PURCHASES

In order to purchase products and services through Hamoye, you will need to give us certain Personally Identifiable Information, such as your name, email address, postal address, credit card information, billing address, shipping address and date of birth.

THIRD-PARTY WEBSITES

If you sign in to a third-party website (such as Facebook) through our app, we might receive Personally Identifiable Information, which could include text and images from that website.

How We Use Information

NON-PERSONAL INFORMATION

We use Non-Personal Information to perform statistical analyses of the behavior and characteristics of our users. We measure the demographics and interest in different parts of our site. We use this information to improve the quality and usefulness of the different services we provide.

PERSONALLY IDENTIFIABLE INFORMATION

We gather Personally Identifiable Information in the ways described in this Privacy Policy. Apart from the instances described here, or unless agreed to by you, we will not disclose any Personally Identifiable Information from you. We may disclose or use Personally Identifiable Information from you in the ways described in this Privacy Policy, or as described below.

UPDATES

When you register for our email and update services, we will use the Personally Identifiable Information you submit to us to send you messages about Hamoye or about the content. In addition, we may store this information so that we can use it in the future for other updates.

FORUMS

In order for you to use our forums, we will use Personally Identifiable Information that we collect from you. We may publish this information on our app or elsewhere. We may store this information for future communications with you.

PARTICIPATION IN ONLINE COURSES

When you take part in our content, we will use Personally Identifiable Information from you in order to manage and process the courses. This information includes, among other things, your attendance and progress. We will also use your Personally Identifiable Information in order to administer exams or other forms of assessment. For instance, if you take part in a proctored exam, it may be necessary to receive Personally Identifiable Information from you in order to verify your identity or in order to monitor your behavior during a test to ensure that the test requirements are being adhered to. If you take part in a course, we may share your Personally Identifiable Information with the educational partner or the instructors who teach or manage the content. If your content is conducted through a university, we may share Personally Identifiable Information about you, your performance and progress with the university. If your content is sponsored by a company, we may share this information with your employer. This information may be shared with them at any time, even after the course has finished. The Personally Identifiable Information that we share about you is subject to the privacy policies of that company. We may store this information for future communications with you.

COMMUNICATION WITH HAMOYE

We may use the Personally Identifiable Information that we receive from you if you send us an email or contact us by another means in order to respond to your message or as otherwise described in this Privacy Policy. We may store this information for future communications with you.

PROVIDING SERVICES TO YOU

When you requests services connected with our content, we collect Personally Identifiable Information and use it to provide those services and for quality control. We may allow you to use chat rooms to communicate with Hamoye staff, for example, and we will use your Personally Identifiable Information in order to provide this service. We may also disclose Personally Identifiable Information about you to third parties if they are providing a service which you have requested, for example to potential employers. We may store this information for future communications with you.

PURCHASES

In order to provide the products or services which you have purchased, we will use Personally Identifiable Information that is collected during the payment process. This may be provided directly by us or through our providers. The billing information may be stored by us or our providers. We may store information other than the billing information for future communications with you.

THIRD-PARTY WEBSITES

Personally Identifiable Information collected from third-party websites can be used by Hamoye internally. If this Personally Identifiable Information contains images of you, Hamoye has the non-exclusive right to use, replicate, share, prepare derivative works of or display such images for fundraising purposes.

DISCLOSURE TO BUSINESS PARTNERS

We may share some of your Personally Identifiable Information with third-party companies, such as businesses offering products, services or opportunities that you may be interested in. However, we will not do this unless we gain your consent.

DISCLOSURE TO SERVICE PROVIDERS

We may provide some limited access of Personally Identifiable Information about you to our operations and maintenance contractors and other service providers while they are providing products or services to us. Such service providers may include technology vendors, test proctoring services or services connected with operating and maintaining the app or online course. We will only provide the Personally Identifiable Information deemed reasonably necessary for these contractors to fulfil their service.

GOVERNMENT AUTHORITIES, LEGAL RIGHTS AND ACTIONS

Hamoye Limited may disclose your Personally Identifiable Information with government authorities as a response to subpoenas, court orders, or other legal processes. We may need to share your information in order to protect our property, or exercise our legal rights. We may do this to defend against legal claims or in any other way that is required by law. We may raise or waive any legal objection or right that is available to us in these cases. In addition, we may share the Personally Identifiable Information you submit to us should we believe it is appropriate for authorities to investigate, prevent, or take any other action regarding suspected illegal activities. We may share this information in order to protect and defend the rights, property and safety of Hamoye, its app, its users, customers, or others, and also in relation to its Terms of Use and other agreements.

DISCLOSURE TO ACQUIRERS

In the event of a sale, a merger or a reorganization of all or most of the equity, business or assets of Hamoye Limited which your Personally Identifiable Information relates to, you information may be shared and/or transferred to the acquirer, assignee or other successor.

Third-Party Tracking

It is possible for third parties such as linked sites and applications (e.g. Facebook), data analytics services and customer support services to collect information about the way in which you use the website. These third parties can utilize tracking technologies relating to the app, which means they can collect information about your activities online over time and across other third-party websites or other online services. Sometimes these tracking tools may collect only Non-Personal Information about your activity. However, it is possible in other cases for them to gather Personally Identifiable Information about you; for example, customer support services can obtain your name and email address in connection to their support activities.

We currently do not monitor or take any action regarding web browser signals or other mechanisms by which users choose to accept or refuse the collection of information over time and across third-party websites or online services, such as ‘do not track’ features on browsers.

External Links

We may provide links to external companies that we believe may be of interest or benefit to you. In relation to these third-party sites, we do not disclose your Personally Identifiable Information without obtaining your prior consent. However, we neither endorse nor are responsible for these third-party sites’ privacy practices. If you click on a link to a third-party website from Hamoye, you should spend time reviewing the privacy policy on that site to see how that website may gather and use your information.

Confidentiality, Security and Retention of Personally Identifiable Information

The confidentiality and security of our users’ information is integral to us as a company. We will take any commercially reasonable measure to ensure that your Personally Identifiable Information remains private, and we will not share it except in the cases provided in this Privacy Policy or in certain cases where we believe such disclosure may be necessary (for example to ensure the physical safety of you or others). We will make every reasonable effort to protect your Personally Identifiable Information from disclosure to or access by external parties. However, please note that we do not guarantee the security of Personally Identifiable Information. Please also bear in mind that we may archive your information in our systems after your Hamoye account has been deactivated.

Updating or Deleting Your Personally Identifiable Information

We have a procedure in place to ensure that your Personally Identifiable Information is up-to-date. You may update your profile containing this information by logging in to the app and visiting your user account page. Please note that we may retain older versions of this information in our databases and other records.

We also maintain a procedure to help you choose whether you would like to receive email communications from us or our partners. You can unsubscribe from these emails by visiting user profile profile.
